General terms and conditions:
This website is managed by YouGoTTC.com, a part of TTC TRAVEL TRADE CARIBBEAN srl, VAT number IT03204590966.
Based in Milan, YOU GO BY TRAVEL TRADE CARIBBEAN is an online Italian tour operator specializing in selling the Cuba destination.
YOU GO BY TRAVEL TRADE CARIBBEAN provide products and services to you subject to the following terms and conditions. Please read these terms and conditions of use before using this website. You consent to these Terms and Conditions when you use this Site, without qualification. If you disagree with any part of the Terms and Conditions, you may not use this Site in any way.
The price of a tourist package will be constituted according to the amount of PAX for which it is requested.
The definitive confirmation of the services and their price will be made only with the issuance of the service documents and the invoice corresponding to them.
The prices include:
1-Assistance in the airports
2-Land transportation or domestic flights listed for each program or excursion.
3-Accomodations in hotels in the specified regimen of each program or excursion.
4-Guide services according to what each program specifies.
5-Specific services included in each program or excursion.
6-Tourist visa for Cuba.
The prices do not include:
-Travel insurance, which is bought through the Agency, will be added as a supplement of the requested package.
-Expenses related to the legal documentation to travel like the paperwork for passports and others.
-Transportation to places not listed on the programs.
-Visits to museums, cultural centers, Natural Parks or other sites not listed on the programs.
-Additional stays or services not specified in the program like telephone calls, laundry service, bank transferences, or additional expenses due to cancellations and changes in the tour and/or other services, delays in arrival and departure of the transportation, or for unforeseen reasons not related to the Agency.
For accommodations in farms:
1. The prices for accommodations are established by PAX.
2. Treatment for children in the accommodations:
- Children from 0 to 2 years, sharing the room with adults, will be free.
- 1 child from 3 to 12 years sharing the room with two adults will get a 50% discount for the price of an adult in a double room.
- 1 child from 3 to 12 years sharing the room with one adult will pay for the room the price of a single.
- 2 children from 3 to 12 years sharing the room with one adult will be pay for the room the price for a double room.
- 2 children from 3 to 12 years in a double room will pay 50% of the agreed upon price.
3. Other supplements:
- Triple room supplement: 25% off for 3rd PAX over price of the contract for an adult in double.
- Additional bed supplement: 40% off for PAX added in the room, from the price agreed upon in the contract, for one adult in a double room.
All accommodations will present a welcome cocktail for groups.
The prices for complementary services for programs or excursions are established per PAX: the participation in the guateque farmers’ parties, tour of the farms, horseback rides, rides on colonial coaches or other typical transportation of the country, scuba diving, snorkeling or other activities.
The prices established for bird watching will only be applied for specialized bird-watching groups. If included in programs for conventional clients, an extra $3.00 per PAX will be charged in all cases.
In the case of the fishing and scuba diving offers the prices and requests for bookings will be made punctually given the specialization of this product and its marketing policy.
Each traveler is responsible for having in order all the necessary documentation to travel. They must have a valid passport and travel insurance.
The non-compliance of these requirements will lead to losing the right to any reimbursement.
The costs related to any migratory paperwork are paid by the clients. The same is applied if the migratory authorities of the country refuse the traveler’s entrance.
The bookings for tourist packages or other programs must be requested 45 days before the date of the start of the program in the Peak Season and 30 days in the Low Season.
Clients’ confirmation of the booking is carried out through the payment of 100% of the value of the total price of the requested program. If not done so, the Agency will be able to cancel the booking.
Your credit card will be debited after making your reservation payment. Accepted credit cards are – VISA, MASTERCARD. Your payment will be to TTC TRAVEL TRADE CARIBBEAN srl, and your bill will state: TTCTRAVELTRADECARIBBEAN.
In the 72 hours after the definitive payment clients will be given the final confirmation of the services, agreed upon between the parties according to the terms and conditions presented here and replacing any previous confirmation.
This confirmation is subject to change, withdrawal or addition only through a new confirmation given to clients 72 hours after the request for some change, and never orally.
THE TOUR OPERATOR will be able to refund the client for the sale of optional activities in the cases that these were not held, protected by the original of the sales document and the cash refund model.
We will not make refunds to credit cards, other than the credit card that was used for your booking. We may process refunds via wire transfer, in which case we will deduct any bank charges from the refundable amount. We aim to process refund within 72 hours after receiving your refund request and required information.
The voucher for the contracting of the services will be handed over directly to the clients on arriving in the country.
The Agency reserves the right to modify the hotel bookings if there is no availability and promises to offer another accommodation of the same category. If the latter were not possible, prior agreement with the clients, they will be changed to a hotel of a lesser category and the corresponding adjustment in the final value will be made.
The Agency will be notified of the cancelations in writing.
The services confirmed to the Agency and not canceled duly in advance of the date of its execution will be penalized in the following way:
In the case of the services on farms (which form part of programs or circuits), trekking, visit to crocodile farms, transportation and other services, total or partial cancelations must be made with a minimum of 72 hours in advance of the previewed hours for providing the services. If within this period of time the clients do not cancel the requested services they will have to pay 50% of the price agreed upon for the requested service.
In the case of accommodations in farms and hotels the cancelations must be made with a minimum of 15 days in advance of the date of the service.
The clients’ No Show makes it necessary to pay for 100% of the first two nights of the service or the confirmed services.
In case of the clients’ No Show in the overnight and other types of accommodations like private homes, 100% of the total value of one night will be charged.
Penalties are not applied for less than two-year-old minors.
For the excursions and territorial programs the terms to be established by claims, no show conditions, devolution and others, they will correspond to those agreed in each territory by the territorial Commission of the National Travel Agencies. If a joint agreement does not exist, the following will be applied:
Excursions with land transportation (bus or jeeps)
– If canceled before the 24 hours of the day previous to the enjoyment of the excursion, 100% is returned
– Starting from the 24 hours of the previous day until the hour of the enjoyment of the excursion, 25% will be discounted.
– The no show to the enjoyment of the excursions, 50% will be discounted.
Excursions that include maritime transportation
– If cancelled before the 24 hours of the day prior to the enjoyment of the excursion 100% will be returned.
– Starting the 24 hours, if clients cancel or don’t show for the enjoyment of the excursion they get a 50% discount on the price of the excursion.
Excursions with accommodations
– Up to 24 hours of the day prior to the Check In, 100% is returned.
– Starting the 24 hours and up to the 12 hours of the day prior to the entrance, 50% is discounted.
– Cancelation after the 12 hours of the day prior to the entrance or no show, 100% of the excursion is discounted.
– No penalties are applied up to two years of age.
– From 2 to 12 years, 50% of the adult’s cost is discounted.
– From 12 years onwards, they are penalized the same as the adults.
In all cases the check-in time is at 16:00 hours and the check out at 12:00 hours.
The description of the hotels that appears on this website is for orientation. You Go Travel and Vacanze will not be responsible for differences that can exist with the reality as a consequence of changes in the building’s structure.
Clients must request the service 7 days before the date of its execution by email if it is not included in the requested services.
The confirmation will be made before 72 hours have gone by, after the request for the service has been presented. The last minute requests will have or not have a reply to their confirmation in 48 hours.
In the case of delayed flights, the Agency will not be responsible when the wait for the agreed upon service exceeds two hours and the withdrawal of the service is necessary. The waiting time will be paid according to the rates the transportation company applies for these cases.
The cancelations that are informed in less than 24 hours in advance, or for NO SHOW will be penalized with 100% of the price of the requested service.
The departure time from the Hotels must be strictly met, the exit before time is not allowed. The Agency is not responsible for the transportation of the passengers who because of hotel, personal, etc. problems cannot take the bus on the previewed time.
Please note prices are not guaranteed until payment is made and accepted. Displayed prices are subject to change but will be confirmed when your booking is completed.
The service must be requested by email up to 7 days before the date of its execution, specifying:
- Name and passport number
- Type of vehicle requested
- Arrival airport
- Airline and flight number
- Date of start and termination of the vehicle’s rental
- Place requested for the handing over of the vehicle.
When arriving in the country clients must pay for the insurance, the guarantee deposit and a tank full of fuel at the offices where they will pick up their rented car.
If drivers do not have a driver’s license or have consumed alcoholic beverages or drugs they will not have the right to the insurance policy’s compensation.
Minimum age to drive: 21 years and a Driver’s License with more than a year of being issued.
Charge for Additional Driver in CUC in the Rental office.
The drop off of the rented car, in other rental offices where the car was picked up, have a surcharge clients must pay in the Rental office where the car was picked up. The rate will be notified in the office.
A No Show is considered three hours after the time established for the car’s pick up and the amount equivalent to one day of rent per each requested service, according to the vehicle’s category, will be charged.
The car must be dropped off at the same time it was picked up, after two hours clients will be charged for one more day of rental.
Cancelations must be notified 72 hours before the time previewed for the car’s pick up, after that time one day of rental will be charged.
All rentals are ON REQUEST. Subject to the confirmation of the lessee.
Rates with limited or unlimited mileage.
Besides our Confirmation E-mail to be received upon completion of the reservation and payment processes, we will send by e-mail a supplier voucher – both documents must be printed and presented upon car collection. YOU GO BY TRAVEL TRADE CARIBBEAN accept no responsibility for delays or the car not being delivered if supplier voucher is not printed and presented to the supplier.
AIRLINE TICKETS FOR DOMESTIC FLIGHTS
The release period for request is 14 days during the low season and 30 days during the peak season, to have full guarantee of the service, if the established terms are not met it will be considered as an ON REQUEST booking subject to confirmation.
The Agency reserves the right to adjust the terms of the request period, with prior notification of the clients.
In case of booking of a group of passengers on flights with reduced or limited capacity, the Agency reserves the right to divide the group, as long as the number of passengers present at the time of providing the service surpasses the amount booked and confirmed, according to the period of request.
The services must be requested in writing where the following data is listed:
-Name of passenger
-Expiry date of passport
-Date and Time
-Hotel where they will be collected
-Other data of interest.
For passengers to use the service they must carry with them the sales document, as agreed upon.
Passengers who do not carry with them the document that accredits the service bought from THE TOUR OPERATOR will be charged in cash at the Airport.
Passengers who present themselves at the Airport with their sales document with the required formalities, but whose booking is not requested and officially confirmed will be provided the service according to the aircraft’s free capacities.
The Agency does not assume the responsibility of guaranteeing domestic or international air connections.
The prices are subject to changes. If this were to occur, clients will immediately be informed, coming into force 15 days after being notified.
In all cases, if the ticket has been issued, when canceled the penalty of 10% of the rate is charged.
If the cancelation is made from 20 to 13 days before the date of the flight, 60% of the penalty on the net rate will be applied.
If the cancelation is made from 10 to 7 days before the date of the flight, 80% of the penalty on the net rate will be applied.
The cancelations made 72 hours before the day of the flight will have a penalty of 100% on the net rate.
No Show will be charged 100% of the ticket’s price.
It will be an indispensable requisite to admit a claim for damages caused by the total or partial non-fulfillment of whichever of the contracted services that the claim be presented by writing within the period of 1 year, counted from the occurrence of the events and always before the definitive departure from the hotel installation where they are staying. In case of thefts, loss of property and other similar personal damages the report to the police authorities by the clients is required.
The Agency is excluded of responsibility before the clients in case of:
-Non-compliance by the clients of the safety norms established in the installations or for the use of the transportation.
-Luggage and personal effects forgotten in the transportation units and visited places.
-Criminal behaviors in which in some way the tourist is involved.
-Consequences beyond our control.
You are fully responsible for the content of your Submissions, (specifically including, but not limited to, reviews posted to this Website). You are prohibited from posting or transmitting to or from this Website: (1) any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material or content that would violate rights of publicity and/or privacy or that would violate any law; (2) any commercial material or content (including, but not limited to, solicitation of funds, advertising, or marketing of any good or services); and (3) any material or content that infringes, misappropriates or violates any copyright, trademark, patent right or other proprietary right of any third party. You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this Website. You acknowledge that TTC TRAVEL TRADE CARIBBEAN may exercise its rights (e.g. use, publish, delete) to any content you submit without notice to you.
SUPPLIER RULES AND RESTRICTIONS
We operate both as an agency model and as principal. This means that where we act as an agency model we act as a disclosed agent for third party suppliers, such as a tour operator, hotel, car rentals, carriers, airlines etc. What this means is that the contract for the product is between you and the supplier. However, we may be liable to you if we have been negligent; we have misrepresented important information or have been in breach of any other relevant law.
Separate terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. Please read these separate terms and conditions carefully. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier’s rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.
No contract will exist between you and TTC TRAVEL TRADE CARIBBEAN for the sale by it to you of any product unless and until TTC TRAVEL TRADE CARIBBEAN accepts your reservation by email confirming your reservation and issuing you a unique confirmation code. Acceptance will be deemed complete and will be deemed to be effectively communicated to you for all purposes at the time that TTC TRAVEL TRADE CARIBBEAN sends the email to you whether or not you receive the email.
USE OF PERSONAL INFORMATION
TTC TRAVEL TRADE CARIBBEAN makes every effort to ensure that the information you exchange with us online, including personal information and credit card details, is treated as securely as possible to protect information sent between your browser and our systems.
SOFTWARE AVAILABLE ON THIS WEBSITE
Any software that is made available to download from this Website (“Software”) is the copyrighted work of TTC TRAVEL TRADE CARIBBEAN, and/or our respective suppliers. Your use of such Software is governed by the terms of the end user license agreement, if any, which accompanies, or is included with, the Software (“License Agreement”). You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms. For any Software made available for download on this Website not accompanied by a License Agreement, we hereby grant to you, the user, a limited, personal, nontransferable license to use the Software for viewing and otherwise using this Website in accordance with these terms and conditions and for no other purpose.
RESTRICTION OF LIABILITY
In no event shall TTC TRAVEL TRADE CARIBBEAN or its subsidiaries or partners be liable for any for delays, accidents, losses, changes of schedules, damages, (whether direct, indirect, punitive, incidental, special, consequential, or otherwise) arising out of, or in any way connected with, the use of or inability to use this web Site or for any information, software, products, or services obtained through or otherwise in connection with this web Site, in each case regardless of whether such damages are based on contract, tort, strict liability, or other theories of liability.

AREA OF JURISDICTION-GOVERNING LAW

PERFORMANCE SUBJECT TO EXISTING LAWS
TTC TRAVEL TRADE CARIBBEAN performance of this agreement is subject to existing laws. Nothing contained in this agreement is in derogation of TTC TRAVEL TRADE CARIBBEAN right to comply with law enforcement requests or requirements relating to your use of this website or information provided to or gathered by TTC TRAVEL TRADE CARIBBEAN with respect to your use of this website.
If any provision of this agreement is determined to be invalid or unenforceable pursuant to applicable law by any court of competent jurisdiction, the other provisions of this agreement will remain in full force and effect. Any provision of this agreement held to be invalid or unenforceable, including but not limited to the warranty disclaimers and liability limitations set forth above, will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.
If as a consequence of Force Majeure, TTC TRAVEL TRADE CARIBBEAN is obliged to curtail, alter or cancel a booking and/or any services agreed, the partner and/or client/customer shall not be entitled to claim compensation for any loss arising as a consequence of the said curtailment, alteration or cancellation. The term “Force Majeure” includes but is not limited to acts of God, natural disaster, fire and any other destruction of any accommodation booked, riots, acts of civil or international war, natural disasters, fires, exercise of municipal, legislative, military or other authority, strikes, industrial action, or any other reason beyond the control of TTC TRAVEL TRADE CARIBBEAN.
AMENDMENT TO THESE TERMS AND CONDITIONS
TTC TRAVEL TRADE CARIBBEAN reserves the right to amend these Terms and Conditions at any time. This Agreement cannot otherwise be altered without prior consultation and agreement with TTC TRAVEL TRADE CARIBBEAN.
These Terms and Conditions contain the entire agreement between TTC TRAVEL TRADE CARIBBEAN and the Client and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified unless expressly agreed by TTC TRAVEL TRADE CARIBBEAN in writing.
You agree to defend and indemnify the TTC TRAVEL TRADE CARIBBEAN and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of your breach of this Agreement or the documents referenced herein; your violation of any law or the rights of a third party; or your use of this Website.
THE INFORMATION, PRODUCTS AND SERVICES PUBLISHED ON THE WEBSITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION SET FORTH ON THIS WEBSITE.
